    ASSUMPTION OF RISK

    The Agency has made no representation as to the suitability, condition or safety of the event or event venue. I acknowledge that participation in the event may involve risks and dangers of accidents, bodily injury, or loss or damage to personal property. These risks may result from my own actions or inactions, as well as the actions or inactions of others or the condition of the facilities and equipment. I understand these risks and voluntarily accept them to the extent permitted by law.

    RELEASE FROM LIABILITY

    To the maximum extent permitted by applicable law, I, for myself and on behalf of my heirs, executors, administrators, estate, insurers, successors and assigns, hereby fully and forever release and discharge the agency, its affiliates and partners, and all event producers, organizers, contractors, volunteers, staff, and venue owners (“Released Parties”) from and against any and all liability, claims, causes of action, costs, losses, or damages arising from or related to my participation in the event—except in cases of personal injury or death resulting from the gross negligence of the Released Parties.

    INDEMNITY

    To the maximum extent permitted by law, I agree to indemnify and hold harmless the Released Parties from any and all claims, losses, damages, expenses, or legal fees resulting from my participation in the event—except where such loss or damage arises from the gross negligence of the Released Parties.

    NO INSURANCE

    I acknowledge that Marathon Studio do not provide personal insurance (e.g., medical, accident, liability) in connection with my attendance or participation. If I wish to be insured, I must arrange this independently.

    AUTHORIZATION TO RECORD AND TO USE RECORDINGS AND NAME

    I agree that the agency and its authorized partners may photograph and/or film me during the event and related activities (“Recordings”). I grant the agency the right to use such recordings worldwide, for a period of five (5) years, without compensation, for promotional, editorial, internal, or commercial purposes in connection with the event or future events. I also allow the use of my name, likeness, and any event-related performance data (if applicable) for the same purposes.

    PERSONAL PROPERTY

    I understand that I am solely responsible for any property I bring to the event and that the agency and Marathon Studio are not liable for any loss or damage to my belongings, whether stored on site or not.

    REJECTION FROM EVENT

    Marathon Studio and/or its event production partners may, at their sole discretion, refuse or revoke my participation in the event if I do not comply with these terms or the instructions of on-site staff. I acknowledge that event participation is personal, non-transferable, and non-refundable.

    CHANGES TO OR CANCELLATION OF THE EVENT

    Marathon Studio reserves the right to change the event date, program, or format or to cancel the event entirely if deemed necessary or reasonable (e.g., due to weather, low attendance, logistical issues, or public health concerns). Marathon Studio shall not be liable for any costs or losses incurred due to such changes, including travel or accommodation expenses.

    COVID-19

    I acknowledge that Marathon Studio may implement health and safety guidelines during the event. Despite precautions, the risk of COVID-19 transmission cannot be eliminated. I accept this risk and release the Released Parties from any liability arising in connection with infection—except in cases of gross negligence.

    ASSIGNMENT

    Marathon Studio may assign the rights granted under this waiver to third parties for the purpose of executing the event or related promotional activity.

    VALIDITY

    If any part of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This waiver overrides any prior oral or written agreements related to the event.

    GOVERNING LAW AND JURISDICTION

    This waiver shall be governed by and construed in accordance with the laws of the participant’s country of residence.

    2. Purpose of Data Collection

    • Managing guest and attendance lists

    • Sending event-related communication

    • Coordinating access and participation

    • Internal post-event reporting

    • Providing guest list data to Marathon Studio and their partners if required

    3. Photography & Filming

    The event may be photographed or filmed by Marathon Studio or authorized third parties. These recordings may be used for:

    • Press and PR

    • Documentation and internal presentations

    • Marketing and social media (e.g., Instagram, LinkedIn, website)

    By attending, you consent to the use of such recordings worldwide, in perpetuity, without compensation, for the purposes above.

    4. Your Rights

    You have the right to:

    • Request access to your data

    • Request correction of inaccurate data

    • Request deletion or restriction of processing

    • Object to processing

    • Request data portability

    • File a complaint with a data protection authority

    5. Legal Basis

    Data processing is based on Art. 6 (1) lit. b GDPR (performance of a contract) and Art. 6 (1) lit. a GDPR (consent). Photo/video processing is based on Art. 6 (1) lit. f GDPR (legitimate interest in documentation and communication).

    6. Withdrawal of Consent

    You may withdraw your consent to data use or image publication at any time with future effect by contacting hello@marathon.studio. Note that withdrawal may affect your ability to attend the event.

    7. Automatic Data Detection

    Some platforms (e.g., iOS, Meta Pixel) may automatically detect and link content such as addresses, phone numbers, or emails. We are not responsible for such third-party-generated links or tracking.
